1. Khái niệm dấu giáp lai?
Hiện nay dấu giáp lai được sử dụng rất phổ biến trong các văn bản, tuy nhiên trong các văn bản pháp luật hiện hành không có định nghĩa về dấu giáp lai. Có thể hiểu, dấu giáp lai là con dấu đóng vào lề phải của tài liệu gồm hai tờ trở lên để đảm bảo tính xác thực của tất cả các tờ thông tin của từng văn bản. Nhằm ngăn chặn thay đổi nội dung làm sai lệch đến kết quả của văn bản trước đó.
Việc đóng và sử dụng dấu giáp lai góp phần hoàn thiện hình thức pháp lý của văn bản và có ý nghĩa quan trọng, đặc biệt với các trường hợp phát sinh tranh chấp trước Tòa án.
2. Cách đóng dấu giáp lai chuẩn?
Theo Khoản 1 Điều 33 Nghị định 30/2020/NĐ/CP quy định về việc sử dụng con dấu như sau:
“1. Sử dụng con dấu
a) Dấu đóng phải rõ ràng, ngay ngắn, đúng chiều và dùng đúng mực dấu màu đỏ theo quy định.
b) Khi đóng dấu lên chữ ký, dấu đóng phải trùm lên khoảng 1/3 chữ ký về phía bên trái.
c) Các văn bản ban hành kèm theo văn bản chính hoặc phụ lục: Dấu được đóng lên trang đầu, trùm một phần tên cơ quan, tổ chức hoặc tiêu đề phụ lục.
d) Việc đóng dấu treo, dấu giáp lai, đóng dấu nổi trên văn bản giấy do người đứng đầu cơ quan, tổ chức quy định.
đ) Dấu giáp lai được đóng vào khoảng giữa mép phải của văn bản hoặc phụ lục văn bản, trùm lên một phần các tờ giấy; mỗi dấu đóng tối đa 05 tờ văn bản.”
Theo quy định trên thì dấu giáp lai được đóng phải rõ ràng, ngay ngắn và đúng màu mực đỏ theo quy định. Việc đóng dấu giáp lai do người đứng đầu cơ quan, tổ chức quy định. Dấu giáp lai phải được đóng vào khoảng giữa mép phải, trùm lên một phần các tờ giấy, mỗi dấu đóng tối đa 05 tờ văn bản.
